Post subject:  being taken to small claims

My husband was just served papers last night for small claims court. Money Mart is taking him to court. We have had no contact with Money Mart since the end of Aug. They said that they tried to contact us and couldn't. I know that is a crock, we have had no phone calls no mail nothing from these guys. I hope the Judge can see our side of the story and take everything into consideration. I have all the paper work, all the emails from the scammer, I have everthing. I even have written down when this John guy from Money Mart first brought all this to lite. Every malicous remark he made to my husband is recorded. All communication stop in Aug. Anyway wish us luck with our fight and I will let you all know how it turns out.

yes we did, we sent them all the info we had on this guy. Everything, emails contacts he gave us, Money Mart called my husband at work and threatened him called him every name in the book. The guy from money mart was very rude. We are going to countersue for harrassment, threatening and anything else we can. They are the ones who would not communicate with us.

Did you send any of this by certified mail so that you have a record that it was sent to them? Or do you even have a copy of a letter that you may have sent to them with the information? This would all be good info to bring with to a court appearance.

You said they called your husband. Need to get your story straight before court.

I sent money mart all the information via email. I have the dates and time they were sent. I made double copies of everything I sent to anyone concerning this. A copy for them and one for us. I live in BC Canada

Small claims court is not like you see on TV, most of the judgement comes from the written affidavits that you submit to the court. If you say in your affidavit that you do not owe them money because you were never contacted by Money Mart, but you want to file a countersuit due to the fact they harrased you or your husband by calling you, you have forfeited both cases. Be careful about your wording of the situation, it is critical to your case.
