Hello everyone!
I fell victim to a counterfeit check scam for $4991.00 . This was a get paid 2 shop scam. Since most of the scams on this site follow a basic pattern I leave those details out, my concern is the safety and security that I didn't receive from the bank!
It amazes me that banks today don't attempt to protect their customers. Particular Chase Bank in this case. I walked in like any other day, went to the teller and deposited the check. No questions asked and no statements made. The next morning I checked online and the money was available. I then proceeded to fall for the scam. Once I found out about the bounced check I asked them for the phone numbers to call and report the problem. After getting a run around on the phone I finally was told to make a police report and go to the branch to file a fraud packet. I got the police report and then went in to the branch and what happened next upsets me.
I went in and told them what I was there to do, and they sent me to the right man. I sat down at this man's cubical and told him that this check that I deposited was a counterfeit (Showing him the copy the bank gave me previously) and I told him I filed a police report. He looked at the business card the officer gave me (which had the report #) smiled and said he knew him. They he proceeded with " Ok let's take care of this, we'll close out the compromised account and get you into a new one. We take care of our fraud customers better then our regular customers, in sense we roll out the red carpet." (These words aren't exact, but the fraud customers and red carpet were used) He then proceeded to have me sign papers and set up a new checking and savings, oh and he applied and approved a credit card for me which I never even asked for! I asked what is going to happen. He said everything will process in a few days and you'll be good as new.
THE PROBLEM
He never explained what the alternate outcome would be. That it will be denied and I would have to pay. That day when I walked out of the bank I felt like a free man. Boy was I misled. A couple days went by and never heard anything. I called my banker and he said it may take a couple more days. I stopped in a few days later and he starting checking things. He had me sign another fraud form and this way it will go straight to a manager to make it go faster. A few days later, nothing. Meanwhile, my account it adding up in late fees and my new checking account now has a negative balance because I haven't deposited any money into it yet and there is an automatic charge for the checks ordered, which he said he would reverse those charges. To this day that has not been done and everyday more fees add up!

Do you think I have a case? Any thoughts or commits? Thank you SVU community!

I think that you need to speak with a GOOD lawyer that works in consumer law . . . what state do you live in?

I have contacted a lawyer who is a family friend ( unfortunately not a consumer lawyer ). He did some reach and I explained my case to him. His advice was to be more bold to the bank in explaining the whole situation. One thing that I have not received from the bank was a written explanation of being denied. I was just told "Since You deposited it". So I agree I need to see it writing.
This is just horrible how bad banks are. Their policy, which took a lot of digging on their website to find, is that they will hold cashier checks of $5000 or greater for a longer period of time. Is this not suspicious when a teller would see a check for $4991. I was never questioned about the validity of the check.
As a long time sales man at my job, I'm aware that it is my responsibility or the store's if I give false information or no full disclosure to a customer and they come back complaining. You better believe that the situation is getting resolved and the customer is walking out happy.
That is why I make sure I walk through everything I need to before that customer walks out the door, even filling out all paper work prior to them leaving so I'm completely off the hook. DO BANKS NOT CARE.

I UNDERSTAND BANKS NEED TO PROTECT THE MONEY, WHAT ABOUT THEIR CUSTOMERS?

If you know someone who is a lawyer that can give you some free advice, then I would take that. I know that with OUR case the bank did not really see that we meant business until we had a lawyer on our side.

The bank will always go back to their policy, which is on their website but hard to find or is in the paperwork that you signed when you set up the account (my responce to my bank was "oh, you mean that information that I signed over 15 years ago when I opened this account and have not looked at again since?!?! Of course I remember everything word for word from that document . . . right!"

I too come from a sales background, and I too agree that if a sales person "words" something incorrectly and leads a customer to think that they are getting something other than what they wanted/exspected and they come back the store will make it right . . . why? because the customer made their choice based on the information that the store's employee gave them. Heck, I can remember a time that we ended up giving a customer a $500 bedding set for $50 because the wrong sign was put in the sign holder. If you read the description you would know right away that it was not for the item that you were looking at, but the sign was there saying that $50, so we had to give it to her . . . and then fix the sign ASAP.

I really appreciate the support and advice I'm receiving from you guys! Tomorrow is the big day I go into the bank with my parents at my side. Now my question is should I mention I've spoke with a lawyer at all, I don't want to incriminate him. I spoke with him, but its not like I have him representing me yet. I also want to make sure I don't say anything stupid, but at my lawyers advice I do have to be firm with my responses. He thinks Chase is bulling me. Any last minute advice?

Be strong and firm, and if they do try and bully you I would mention that you have already spoken with a lawyer. Don't exspect them to be nice . . . be ready for them to tell you that it was not a smart move on your part and to blame you, at which point you can mention their poor training on this issue because better training would have caught this.
